Heard learned counsel for the petitioner and the learned Additional Government Advocate for the State.
The petitioner is apprehending arrest for the alleged commission of offences punishable under Sections 498A/ 324/ 323/ 294/ 506 of the I.P.C. read with Section 4 of the D.P. Act in G.R. Case No.56 of 2020, of the court of the learned J.M.F.C. Ranpur, arising out of Ranpur P.S. Case No.43 of 2020.
No criminal antecedent is reported against the petitioner. Moreover, the petitioner is a permanent resident of village Binodpada, P.S.- Ranpur in the district of Nayagarh. Hence, there is no chance of his abscondance from the process of justice. There is also no allegation on behalf of the prosecution that the petitioner shall tamper the prosecution evidence, if he is released on bail.
Keeping in view the aforesaid consideration, the application for anticipatory bail of the petitioner is allowed. On the event of his arrest, the petitioner shall be released on bail by the Arresting Officer on such terms and conditions as deemed just and proper by him/her in the aforesaid case.
