Considering the submissions made and on going through the averments take in the petition as also the earlier order dated 17.11.2020, the following order stands substituted as under:
“The matter is taken up through video
conferencing.
Heard learned counsel for the petitioner and
learned counsel for the State.
Considering the submissions made and keeping in view the nature of accusations; further taking into account the role said to have been played by this petitioner as also the surrounding circumstances; while being not inclined to grant anticipatory bail to the petitioner, it is observed that in the event the petitioner surrenders in the court in seisin of the case in connection with Rayagada P.S. Case No.456 of 2019 corresponding to T.R. No.5 of 2020 pending on the file of learned Additional District & Sessions Judge-cum-Special Court, POCSO, Rayagada, within four weeks hence and moves for his release on bail, the same shall be considered on its own merit without being influenced by this order and disposed of early in accordance with law.”
