By way of this writ petition, the petitioner has prayed for a direction to opposite parties to make payment of the dues towards security deposit arising out of work relating to the contract agreement for the work “Renovation of drainage channel in between Khandahata distributary and Benagaon minor (Ardhanga Nallah) from RD 0.800 KM to 6.360 K.M. (RIDF-XII)”.
Learned counsel for the State placed reliance on paragraph-8 of the counter affidavit, which is filed in Court today. For ready reference, paragraph-8 of the counter filed in Court today is extracted hereunder:-
“8.That in reply to the averments made in paragraph-3.4 of the writ petition it is humbly submitted that after receipt of representation of the petitioner vide Letter No.Nil Dt.05/11/2012, this office has requested the petitioner to submit the claim of Security Deposit in proper format. An amount of Rs.6,10,927/- )Rupees Six Lakh ten thousand nine hundred twenty seven only) towards deposit of security money for this work was deducted from his Running Bills from 1st RA to 8th RA. Thereafter, out of the above security deposit an amount of Rs.5,88,664/(Rs.6,10,927=00 –Rs.22,263=00). ....”
In view of the above, nothing remains to be decided in this writ petition. Accordingly, the same stands disposed of.
