Heard learned counsel for the petitioner and Mr.
S. Mishra, learned Addl. Government Advocate.
The petitioner has filed this application seeking direction to the opposite parties to promote/appoint him as reader in terms of the resolution dated 19.03.1990 as amended by the government keeping in view the fact that the juniors to the petitioner have already promoted under Annexure-2 without deducting 5 years of their service.
Mr. A.N. Pattnaik, learned counsel for the petitioner contended the similar question has come up for consideration before this Court in OJC No.3837 of 1998 disposed of on 17.01.2019 ( Pramod Kumar Jena and others v. State of Orissa and others ). Therefore, liberty may be granted to the petitioner to the petitioner to make a representation before the authority ventilating his grievance within two weeks, so that the same can be considered by the authority in the light of the order passed by this Court in Pramod Kumar Jena (supra). To which, Mr. S. Mishra, learned Addl. Government Advocate has no objection.
Considering the contention raised by learned counsel for the petitioner, this writ petition stands disposed of permitting the petitioner to file fresh representation before the authority ventilating his grievance which has been raised in the present application within a period of two weeks. If such application is filed, the same shall be considered by the authority taking into consideration the order passed in
Pramod Kumar Jena (supra) and pass appropriate order in accordance with law within a period of three months from the date of filing of such representation.
