The petitioner files this writ application seeking direction to opposite parties no.2 and 3 to make payment of back wages (salary dues) along with other service benefits, such as, earned leave, increased allowances, etc. as per Orissa Primary Education Programme Authority Service Rules and Regulations, 1996 for the period from 01.05.2010 top 02.05.2012, i.e., the period for which the petitioner was illegally deprived of his job.
Mr. D.Mishra, learned counsel for the petitioner has contended that by virtue of the order dated 29.02.2012 passed by this Court in W.P.(C) No. 3433 of 2011, the petitioner has been reinstated in service by order dated 02.05.2012 in Annexure-4, but for the period from 01.05.2010 to 02.05.2012, for which the petitioner was illegally not permitted to discharge his duty, he has not been paid his legitimate dues.
Mr. S.Mishra, learned Add. Government Advocate appearing for the State opposite parties, on the other hand, has contended that for the benefits,
which the petitioner is now claiming in this writ application, he has never approached the authority concerned.
In view of the above submission, learned counsel for the petitioner has contended that liberty may be granted to the petitioner to move the appropriate authority so that his grievance can be considered.
In view of the above, the writ petition is disposed of granting liberty to the petitioner to approach the appropriate authority claiming his aforesaid dues.
