Heard learned counsel for the petitioner and learned counsel for the Revenue Department.
By way of this writ petition, the petitioner has challenged the order passed by the Sales Tax Officer, Cuttack-opposite party no.1 under Annexure-1 series and the order dated 06.05.1997, passed by the Addl. Commissioner of Sales Tax, Cuttack-opposite party no.2 under Annexure-2.
Learned counsel for the opposite parties-Revenue Department submits that the original records pertaining to this writ petition are not available as the matter is of the year 1997.
Only on the ground of non-availability of original records, the writ petition is disposed of.
However, if the original record is traceable by the Department, it will be open for the petitioner to revive this writ petition.
