Taking into consideration the submission of learned counsel for the parties and on perusal of the record, it appears that the learned Civil Judge (Sr.Divn), Keonjhar has relied upon Ext.1 to 3 to assess the market value of the acquired land. Although contention was raised by Mr. Rath, learned counsel for the appellant to the effect that working sheet was not taken into consideration, but on perusal of the records, it appears that neither any witness on behalf of the appellant was examined nor any document was produced in support of their case. Thus, learned Civil Judge (Sr.Divn), Keonjhar has committed no error in relying upon the sale deeds under Ext.1 to 3 for determination of the market value of the land. On perusal of the materials on record, the enhancement of the award does not appear to be excessive. l 6. Thus, I find no reason to interfere in the impugned judgment and, therefore, the appeal stands dismissed. It is however, directed that the enhanced amount along with interest and other statutory deposit shall be released in favour of the claimant-respondent within a period of eight weeks hence on proper identification.
