01.08.2019 Heard learned counsel for the petitioner and Mr. Dash, learned Additional Standing Counsel.

The petitioner, by filing this application, has invoked the jurisdiction of this Court under Article 227 of the Constitution of India for directing the opposite party No.3 (Inspector-in-Charge, Karanjia P.S.) to register the complaint vide I.C.C Case No.82 of 2017 forwarded by the learned S.D.J.M., Karanjia under Section 156(3) of the Cr.P.C. by order dated 19.08.2017.

Learned counsel for the petitioner submits that as per the instruction received, although the complaint being forwarded under Section 156(3) of Cr.P.C. by the court below has been received by the opposite party No.3 (Inspector-in-Charge, Karanjia P.S.), no further action has been taken at his end.

Learned Additional Standing Counsel submits that the complaint once received by the opposite party No.3 from the court being forwarded under Section 156(3) of the Cr.P.C., he is under legal obligation to deal with the same in accordance with law and proceed further in the matter in finally submitting a report to the concerned court.

Considering the submissions made, the present application is disposed of with an observation that in the event, the opposite party No.3 has received the complaint being forwarded by the learned S.D.J.M. Karanjia under Section 156(3) of the Cr.P.C. vide order dated 19.08.2017 passed in ICC Case No.82 of 2017, he would do well to take all such effective steps as provided in law in the matter of investigation and complete the same as expeditiously as possible.
