This is an application under section 439(2) of Cr.P.C. for cancellation of bail.
The petitioner has prayed to quash the bail order granted by this Court on 13.10.2017 in BLAPL No.6821 of 2016. It is stated at the Bar that similar application has also been filed before the Addl. Sessions Judge –cum- Designated Court, OPID, Balasore which is subjudiced.
Learned counsel for the petitioner submitted that at the time of filing of this application, the Designated Court was not functioning and at present the Presiding Officer has joined and therefore, he seeks permission to withdraw this application to pursue the cancellation of bail application filed before the Designated Court.
In view of such submission, the CRLMA application is disposed of as withdrawn giving liberty to the petitioner to pursue the application before the Designated Court.
