Heard learned counsel for the petitioner and the learned Additional Standing Counsel for the State.

The petitioner- Siba Sankar Panigrahi @ Jitu Kona is in custody for alleged commission of offences punishable under Sections 307/353 of the I.P.C. read with Sections 25 and 27 of the Arms Act in C.T. Case No.06 of 2019, of the court of the learned C.J.M.-cum-Assistant Sessions Judge, Jeypore, arising out of Jeypore Town P.S. Case No.235 of 2018, corresponding to G.R. Case No.844 of 2018.

The petitioner has been charge-sheeted and committed to the court of Sessions for alleged commission of offences under Sections 307/ 353 of the I.P.C. read with Sections 25 and 27 of the Arms Act.

Admittedly, no injury has been sustained by the informant or any other party. But, it appears that an exchange of fire took place between the police and the petitioner.

Learned Additional Standing Counsel very vehemently opposes the bail stating that there are as many as 10 criminal antecedents pending against the petitioner.

Keeping in view the aforesaid consideration and the fact that the petitioner is a permanent resident of villageJeypore, P.S.- Jeypore Town, in the district of Koraput, this Court is inclined to grant bail to the petitioner on stringent conditions.

Accordingly, the BLAPL is allowed. Let the petitioner be released on bail in the aforesaid case by the

learned C.J.M.-cum-Assistant Sessions Judge, Jeypore on the conditions that:

(i) the petitioner shall furnish a bail bond of Rs.1,oo,ooo/- (Rupees One Lakh Only) with two solvent sureties each for the like amount to the satisfaction of the learned C.J.M.-cumAssistant Sessions Judge, Jeypore;

(ii) the petitioner shall appear before the court in seisin over the matter on each date of posting. However, the same is subject to the powers of the court, in seisin, under Section 317 of the Cr.P.C.;

(iii) the petitioner shall also report before the I.I.C., Jeypore Town Police Station, Jeypore every Monday till completion of the trial in between 10.00 A.M. to 1.00 P.M.;

(iv) the petitioner shall not indulge himself in any kind of criminal activity while on bail;

It is made clear that if the petitioner violates any of the aforesaid conditions, bail granted to him shall be liable for cancellation by the court in seisin over the matter without any further reference to this Court.
