It is submitted on behalf of the petitioner that only 11 kg. of contraband ganja was allegedly seized from the possession of the petitioner, to which learned Additional Standing Counsel for the State does not dispute. The petitioner is inside custody since 26.9.2019.
The quantity of ganja so allegedly seized is admittedly below the commercial quantity and considering the period of detention of the petitioner inside custody, it is directed to release the petitioner on bail in connection with P.R. No.88/2019-20 corresponding to 2(a) CC No.2/2019 (NDPS) on the file of learned Sessions Judge-cum-Special Judge I/C, Bhawanipatna, Kalahandi on such terms and conditions to be fixed by the learned court below in seisin over the matter.
The BLAPL is accordingly disposed of.
