Heard learned counsel for the petitioner and the learned counsel for the State.
This is an application under Section 439 Cr.P.C. in connection with S.T. Case No.43 of 2018 arising out of Astaranga P.S. Case No.55 of 2018 pending in the Court of learned Addl. Sessions Judge, Nimapara for offences punishable under sections 326/307/302 of the Indian Penal Code.
The petitioner moved an application for bail before the Court of learned J.M.F.C., Nimapara which was rejected on 29.10.2018.
Perused the statement of Biswajit Nayak, son of the deceased Sarat Nayak. The manner in which the petitioner assaulted her husband Sandeep Nayak and also father-inlaw Sarat Nayak and the nature and gravity of accusation, I am not inclined to release the petitioner on bail.
Accordingly, the BLAPL stands dismissed.
