This is an application under section 439 Cr.P.C. for grant of bail to the petitioner in connection with Sasan P.S. Case No. 168 of 2018 corresponding to G.R. Case No. 2695 of 2018 pending in the Court of learned S.D.J.M., Sambalpur for offences punishable under sections 452/354-B/323/506 of the Indian Penal Code.
Considering the submission made by the learned counsel for the petitioner that the petitioner is in judicial custody since 12.09.2018 and charge sheet has already been submitted under sections 452/354-B/323/506 of the Indian Penal Code and after going through the statement of the victim and the fact that the offences are triable by Magistrate and on hearing the learned counsel for the State, I am inclined to release the petitioner on bail.
Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000.00 (rupees twenty thousand) with two solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper.
The BLAPL is accordingly disposed of.
