Pursuant to the order dated 27.02.2019, Mr.Jashobanta Narayan Pradhani, Inspector in-charge of Tusura Police Station is present.

Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 Cr.P.C. in connection with Tusura P.S. Case No. 113 of 2018 corresponding to G.R.Case No. 498 of 2018 pending in the court of learned S.D.J.M., Balangir for alleged commission of offences under section 395 of the Indian Penal Code and sections 25 and 27 of the Arms Act.

The prayer for bail of the petitioner has been rejected by the learned Sessions Judge, Balangir by order dated 07.08.2018.

This is a case under section 395 of the Indian Penal Code and the petitioner has been identified in the Test Identification Parade.

Considering the nature and gravity of accusation, I am not inclined to release the petitioner on bail. The prayer for bail stands rejected. However, the petitioner may renew his prayer for bail after examination of the identifying witnesses in the trial Court.

Learned counsel for the petitioner has produced copy of the bail order of the co-accused Achuta @ Achit Meher, who has been granted bail. It appears that the said Achit Meher has been identified in the Test Identification Parade.

Issue notice to Achuta @ Achit Meher as to why the bail granted to him shall not be cancelled.

Registry is directed to send notice by registered post.
