The petitioner being in custody in connection with Athamallik P.S. Case No. 102 of 2018 corresponding to Special Case No. 03 of 2018 on the file of learned Addl. District & Sessions Judge-cum-Special Judge, Athamallik for alleged commission of offence under section 20(b)(ii)(C) of the NDPS read with section 279/337 of the IPC, has filed this application under section 439 of the Cr.P.C. for his release on bail.
Upon hearing the learned counsel for the petitioner and learned counsel for the State, this application stands disposed of with an observation that in case the trial has not yet been completed, the petitioner would be at liberty to renew his prayer for grant of bail by filing an application before the court in seisin of the case citing all such developments which have taken place in the meantime for their consideration in proper perspective.
The BLAPL is accordingly disposed of.
