The petitioner being in custody in connection with Orkel P.S. Case No. 137 of 2018 corresponding to T.R. Case No. 140 of 2018 on the file of learned Sessions Judge-cum-Special Judge, Malkangiri running for alleged commission of offence under section 20(b)(ii)(C)/ 25/29/27-A of the NDPS Act, has filed this application under section 439 of Cr.P.C for his release on bail.
Heard learned counsel for the petitioner and learned counsel for the State.
Considering the submissions made and on going through the materials including the quantity of contraband ganja said to have been seized from the possession of the petitioners on record; further keeping in view the surrounding circumstances of the case, at this stage, I am not inclined to accept the prayer for grant bail to the petitioner.
The BLAPL is accordingly dismissed.
