17.04.2019 Heard learned counsel for the petitioner and the learned counsel for the State.

This is an application under Section 439 Cr.P.C. in connection with C.T. Case No.322 of 2018 arising out of Cyber Crime P.S. Case No.21 of 2018 pending in the Court of learned J.M.F.C., M. Rampur for offences punishable under sections 419/420/465/468/34 of the Indian Penal Code read with section 66(C)/66(D) of Information technology Act, 2000.

The petitioner moved an application for bail before the Court of learned Sessions Judge, Kalahandi, Bhawanipatna which was rejected on 01.02.2019.

Learned counsel for the petitioner submitted that the petitioner is in judicial custody since December 2018 and in the meantime, investigation has made substantial progress and the offences are triable by Magistrate. Learned counsel for the petitioner further submitted that as per the order dated 10.04.2019, he has obtained instruction from the petitioner that the petitioner is ready and willing to deposit a sum of Rs.4,36,000/- (rupees four lakh thirty six thousand) in the Court and therefore, the bail application may be favourably considered.

Learned counsel for the State has no serious objection for grant of bail to the petitioner.

Considering the submissions made by the learned counsels for the respective parties, the nature of accusation against the petitioner and taking into account the period of detention of the petitioner in judicial custody,

I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing cash security of Rs.4,36,000/(rupees four lakhs thirty six thousand) in the shape of fixed deposit in any Nationalised Bank pledged in the name of the Court in seisin over the matter and bail bond of Rs.50,000/- (rupees fifty thousand) with two solvent sureties each for the like amount to the satisfaction of the learned Court in session over the matter with further terms and conditions as the learned Court may deem just and proper.

Accordingly, the BLAPL is disposed of.

Urgent certified copy of this order be granted on proper application.
