This is an application under section 439 Cr.P.C. in connection with Rupsa P.S. Case No.11 of 2018 corresponding to C.T. Case No.445 of 2018 pending in the file of learned S.D.J.M., Balasore for alleged commission of offence under section 366 of the Indian Penal Code.
The prayer for bail of the petitioner has been rejected by the learned 2nd Addl. Sessions Judge, Balasore vide order dated 22.01.2019.
Considering the submission made by the learned counsel for the petitioner that the petitioner is in custody since 03.01.2019, charge-sheet has already been submitted under section 366 of the Indian Penal Code and after going through the 164 Cr.P.C. statement of the victim produced by the learned counsel for the State, I am inclined to release the petitioner on bail.
Let the petitioner be released on bail in the aforesaid case on furnishing a bail bond of Rs.20,000/- (rupees twenty thousand) with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin over the matter with further conditions as the learned Court may deem just and proper.
The BLAPL is accordingly disposed of.
