Learned counsel for the petitioner submitted that the petitioner is in judicial custody since 08.02.2017 and he has been charge sheeted under sections 302/201/34 of the Indian Penal Code and one of the co-accused, namely, Sumanta Budula has been released on bail by this Court in BLAPL No.1656 of 2019 vide order dated 26.03.2019. He files the copy of the bail order, which is taken on record. It is further submitted that there are no eye witnesses to the occurrence and the case is based on circumstantial evidence. The case of the prosecution is that the deceased Mayabati Bag was having love affairs with the petitioner and after the deceased married in some other place, the petitioner became vindictive which is stated to be the motive behind the crime. The further prosecution case is that on 01.02.2017, the petitioner and co-accused Sumanta Budula along with the deceased were seen proceeding in one motorcycle and on 03.02.2017 the dead body of Mayabati Bag was found.
