15.04.2019 Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 Cr.P.C. in connection with Salipur P.S. Case No.272 of 2018 corresponding to G.R. Case No. 996 of 2018 pending in the file of learned J.M.F.C.,Salipur for alleged commission of offences under sections 419, 420,467, 468, 471, 120-B of the Indian Penal Code.

The prayer for bail of the petitioner has been rejected by the learned Addl. District and Sessions Judge, Salipur vide order dated 31.01.2019.

Learned counsel for the petitioner submitted that the petitioner is in custody since 19.01.2019, the offences are triable by Magistrate, the investigation has made substantial progress and one of the co-accused has already been released on bail and therefore, the bail application may be favourably considered.

Learned counsel for the State has produced the case diary and opposed the prayer for bail.

Considering the submission made by the learned counsel for the respective parties, nature of accusation against the petitioner, the period of detention and the fact that the offences are triable by Magistrate, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing a bail bond of Rs.20,000/- (rupees twenty thousand) with two local sureties each for the like amount to the satisfaction of the learned Court in seisin over the matter along with cash security of rupees one lakh and with further conditions as the learned Court may deem just and proper.

The BLAPL is accordingly disposed of.
