19.07.2019: The petitioner being in custody in connection with Banharpali P.S. Case No. 103 of 2018 corresponding to S.T. Case No. 72 of 2018 arising out of C.T. Case No. 1721 of 2018 on the file of learned District & Sessions Judge, Jharsuguda running for alleged commission of offence under section 395 of the IPC, has filed this application under section 439 of the Cr.P.C. for his release on bail.

Learned counsel for the petitioner submits that on the basis of the statement of one accused said to have been made before the police after arrest, this petitioner has been arrested and thereafter material has been collected as to his identification which under circumstance appears to be doubtful. He further submits that the petitioner has by now remained in custody for more than ten months and the investigation has been complete. In view of above, he urges for grant of bail to the petitioner.

Learned counsel for the State opposes the move in view of the fact that, he has been identified in the T.I. parade and have criminal antecedent.

Considering the submissions made and on going through the materials as placed, further keeping in view the surrounding circumstances as also the period of detention of the petitioner in custody and in the absence of any other impediment, it is directed that the petitioner be released on bail in the aforesaid case on such terms and conditions as deemed just and proper by the court is seisin of the case with further conditions that he shall not fail to appear in person before the court in seisin of the case and

will appear before the concerned Officer-in-Charge of Dhanupali Police Station in every Sunday in between 10.00 AM to 2.00 PM for a period of next six months and will not indulge in any criminal activity.

The BLAPL is accordingly disposed of. Issue urgent certified copy as per rules.
