Learned counsel for the petitioners submits that these petitioners being the relatives of the principal accused against the victim has been made alletations for commission of principal offence; have been unnecessarily arraigned in the case. In view of all the above, when there remains least scope on the part of the petitioners to flee from justice and tamper the evidence, he urges for release of the petitioners on bail in the event of their arrest in the case.
Learned counsel for the State does not dispute the fact that the principal accused in the case is Prafulla Harijan.
Considering the submissions made and viewing the nature of accusation against these petitioners as well as other surrounding circumstances, it is directed that in the event petitioners surrender before the court in seisin of the case in the aforesaid case within two weeks hence and move for their release on bail, they shall be released on bail on such terms and conditions as would be deemed just and proper by the said court.
The ABLAPL is accordingly disposed of.
