This is an application under Section 438
Cr.P.C.
Learned counsel for the petitioners does not want to press the application for bail, so far as Petitioner No.1-Shastri Bag is concerned. Accordingly, the present ABLAPL in respect of Petitioner No. 1-Shastri Bag is dismissed as not pressed.
So far as Petitioner No.2-Bhagirathi Bag and Petitioner No.3-Parbati Bag are concerned, taking into consideration the facts and submissions, factum of permanent residence of the petitioner nos.2 and 3 and nature of allegation, it is directed that petitioner nos.2 and 3 shall surrender before the learned J.M.F.C., Saintala and apply for bail in connection with Saintala P.S Case No.42 of 2018 corresponding to G.R. Case No.52 of 2018 within 15 (fifteen) days from the date of reopening of the Court after the ensuing ‘Summer Vacation’. In the event of their surrender and motion for bail, learned J.M.F.C., Saintala shall release each of the petitioner nos.2 and 3 on bail on such terms and conditions as deemed just and proper.
The ABLAPL is accordingly disposed of.
