Heard, learned counsel for the petitioners, learned counsel for the informant and learned counsel for the State.
Perused the dying declaration of the victim where she stated that she committed suicide and no one is responsible for her death. No doubt allegation of dowry torture has been made which stated to have drove the victim to commit suicide.
Considering the aforesaid statement of the victim and also the fact that the petitioners are the father-in-law, mother-inlaw and sister-in-law of the victim and also nothing is there on record indicating the fact that the petitioners shall abscond and/or tamper with the prosecution evidence, if released on prearrest bail, this Court is of the view that the petitioners in this case deserves to be released on pre-arrest bail.
Hence, this Court directs that in the event of arrest of the petitioners in connection with the aforesaid case, they be released on bail by the Officer effecting arrest on such terms and conditions as deemed just and proper.
The ABLAPL is, accordingly, disposed of being allowed. Urgent certified copy of this order be granted on proper application.
