04.04.2019 The petitioner in this case having been implicated in Dhenkanal Sadar P.S. Case No.70 of 2019 corresponding to G.R. Case No.156 of 2019, pending in court of learned S.D.J.M., Dhenkanal for alleged commission of offences punishable under Sections 341, 323, 294, 506/34 of I.P.C. and Section 25 of the Arms Act, has filed this petition for his release on pre-arrest bail.

Heard learned counsel for the petitioner and the learned counsel for the State.

Perused the F.I.R.

Regard being had to the facts and submissions made, especially the nature of accusation, circumstances in which the offences alleged to have been committed, factum of release of the co-accused on bail by this Court vide order passed in ABLAPL No.3055 of 2019 and hardly any material being there to suggest that the petitioner is likely to abscond or tamper with the prosecution evidence, if released on prearrest bail, this Court directs that in the event of arrest of the petitioner in connection with the aforesaid case, he be released on bail by the Arresting Officer on such terms and conditions as he may deem just and proper.

The ABLAPL is, accordingly, disposed of being allowed.
