The petitioners have prayed to release them on bail under Sec.438 Cr.P.C. in connection with Sahadevkhunta P.S. Case No.20 of 2014 corresponding to C.T. Case No.122 of 2014 pending on the file of learned S.D.J.M., Balasore.
It is submitted on behalf of the petitioners that the allegations are to the extent that some people have entered into the office of the Samaj at Balasore and destroyed the valuable articles. It is further submitted that many co-accused persons have already been released on anticipatory bail by this Court in BLAPL No.2539 of 2014 and other petitions. It is submitted that till date, the charge-sheet has not been filed in this case and the investigation is still pending.
On consideration of the fact that other co-accused persons have already been released on bail, it is directed to release the present petitioners on bail in connection with the aforesaid case in the event of their arrest by the investigating officer subject to the condition that the charge-sheet has not been filed yet in the case as submitted by learned counsel for the petitioner.
The ABLAPL is disposed of accordingly.
