5 11.12.2018 Heard Mr. A. Swain, learned counsel for the petitioner and Mr. S.K. Samal, learned Standing Counsel for School and Mass Education Department.

The petitioner has filed the writ petition to quash the result of rejection list of candidates of Class-VII due to No Certificate of Registration/No Objection Certificate of the Schools in respect of the petitioner at Sl. No.28 vide Annexure-8. She further seeks for direction to allow her to take admission Class-VII in special case by creating a seat in the Adarsa Vidyalaya for the academic session 2018-2019.

Mr. A. Swain, learned counsel for the petitioner states that seats are lying vacant in Class-VII in Odisha Adarsa Vidyalaya under Begunia Block in the district of Khurda for the academic session 2018-19. As such, in the event the writ petition is allowed, the petitioner will get an opportunity to prosecute her study in a better institution.

Mr. S.K. Samal, learned Standing Counsel for School and Mass Education Department produces instructions received from District Education Office, Khordha dated 19.06.2018 wherein it has been specifically stated denying the illegal and arbitrary action of the opposite parties and the vacant of seat or creation of seat is not possible since the admission process of Odisha Adarsa Vidyalaya, Begunia for the academic session 2018-19 has already been completed

wherein a total 160 nos. of students (80 nos. in ClassVI and 80 nos. in Class-VII) have already taken admission fulfilling the seats allotted by Odisha Adarsa Vidyalaya and the classes of both class-VI and VII are going to be commenced from 21.06.2018 after summer vacation.

Considering the contentions raised by learned counsel for the parties and after going through the instructions produced before the Court, it appears that seats are not available. More so, the academic session has already begun from June 2018 and in the midst of session this Court is not inclined to grant the benefit to the petitioner as claimed in the writ petition.

Accordingly, the writ petition stands dismissed.
