Heard Mr. Purusottam Chuli, learned counsel for the petitioner and Mr. R.P. Mohapatra, learned Additional Government Advocate for the State.

The petitioner in the writ application is praying for a direction to the Commissioner-cumSecretary, Higher Education Department, Government of Odisha, Bhubaneswar (opposite party no.1) to allow the revised U.G.C. pay of scale.

Mr. Chuli, learned counsel for the petitioner submits that the case of the petitioner is squarely covered by the decision of the Apex Court in the case of State of Orissa & Anr. Vrs. Mamata Mohanty , reported in 2011(1)CLR(SC)-494. He submits that the petitioner has made a representation to the Commissioner-cum-Secretary, Higher Education Department, Government of Odisha, Bhubaneswar (opposite party no.1), dated 05.05.2018 (Annexure-7) ventilating his grievance. He further submits that the said representation may be disposed of expeditiously.

Considering the submission made and without expressing any opinion on the merits of the case, this writ petition is disposed of with a direction

to the Commissioner-cum-Secretary, Higher Education Department, Government of Odisha, Bhubaneswar (opposite party no.1), to dispose of the representation of the petitioner dated 05.05.2018 (Annexure-7) in accordance with law, as expeditiously as possible, preferably within a period of six months from the date of receipt of certified copy of this order.

In the event, the opposite party no.1 comes to a conclusion that the petitioner is entitled to U.G.C. pay of scale, as laid down by the Apex Court in the case of Mamata Mohanty (Supra) , necessary steps shall be taken to pay the said amount.

Writ petition is dispose of.
