By way of this writ petition, the petitioner has prayed for a direction to the opposite parties, to fix up his seniority in the all India Seniority List as per the Final Zonal Seniority list.

In course of hearing, it is stated at Bar that Central Administrative Tribunal is the appropriate forum for redressal of petitioner’s grievance. Accordingly, learned counsel for the petitioner prays for liberty to file appropriate application before the jurisdictional Central Administrative Tribunal.

In that view of the matter, the writ petition is disposed of with the liberty to the petitioner to file appropriate application before the Central Administrative Tribunal having jurisdiction to deal with the matter, if so advised. It may be observed that if such an application is filed, we hope and trust that the learned Tribunal will consider and dispose of the same within a period of four weeks from the date of submission of pleadings of the respective parties, keeping in view the facts and circumstance of the case. It is made clear that the decision of the Department regarding fixation of seniority of the petitioner, which is impugned before this Court, shall be subject to the result of the application that would be filed by the petitioner, as undertaken.
