This order arises out of an appeal preferred by Smt. Kanakalata Dash, who sustained injury in a motor vehicle accident on 07.03.1986, at about 5 P.M. The petitioner and others were standing on the left side of Pipili-Konark road. At that time the trekker bearing Regd. No. WMF-8874 came in high speed without blowing horn and due to rash and negligent driving, the driver could not control the vehicle and the same ran over the petitioner and others. Some persons died at the spot and the petitioner sustained injury and was shifted to the District Headquarters Hospital, Puri. She was treated there as a outdoor patient. The learned 3rd MACT, Puri disposed of four M.A. cases and as per the common judgment dated 25.02.2004, so far as the petitioner in MAC No.818/1987 is concerned, two witnesses were examined, namely, Amiya Moharana and Bijaya Kumar Das. Though the petitioner has not been examined, no sufficient cause for her non-examination has been assigned and the documents filed by her were not exhibited, the 3rd MACT, Puri allowed her application and awarded Rs.2,000/- for the injury sustained by her. In his order, it is seen from the certified copy of the injury report that the petitioner has sustained lacerated injury over the right eye brow and one bruise on the right palm due to the accident. Hence, he awarded Rs.2,000/-.
