The petitioner being in custody in connection with Angul P.S. Case No. 175 of 2018 corresponding to G.R. Case No. 384 of 2018 on the file of learned S.D.J.M., Angul running for alleged commission of offence under sections 399/402 IPC read with section 25/27 of the Arms Act, has filed this application under section 439 of the Cr.P.C. for his release on bail.
Heard learned counsel for the petitioner and learned counsel for the State.
Considering the submissions made and on going through the materials as placed including the statement of the victim, further keeping in view the period of detention of the petitioner in custody as also other surrounding circumstances and in the absence of any other impediment, it is directed that the petitioner be released on bail in the aforesaid case on such terms and conditions as deemed just and proper by the court in seisin of the case with further condition that he shall report before the IIC, Angul P.S., every Sunday in between 10.00 AM to 2.00 PM for a period of next three months.
The BLAPL is accordingly disposed.
