ABLAPL No.9693 OF 2018
The petitioner having been implicated in Ramchandi P.S. Case No.37 of 2018 corresponding to G.R. Case No.198 of 2018 on the file of learned J.M.F.C., Konark for alleged commission of offence under sections 457/342/294/420/406/323/307/114/379/386/506/34 of IPC, has filed this application under section 438 of Cr.P.C. for grant of bail in the event of his arrest in the said case.
Heard learned counsel for the petitioner, the learned counsel for the informant and the learned Additional Standing Counsel.
Considering the submissions made and keeping in view the nature allegations made against the petitioner, while being not inclined to grant anticipatory bail, it is directed that in the event the petitioner surrenders before the Court in seisin of the case within two weeks hence and moves for bail, he shall be released on bail on such terms and conditions as would be deemed just and proper by the said court with a further condition that he will cooperate with the investigation as and when called for and will not tamper with the evidence in any manner whatsoever.
The ABLAPL is accordingly disposed of.
