03. 23.02.2017 This writ application has been filed for issuance of direction to opposite party no. 2 to allow petitioners institution by accepting forms and the fees for appearing in the Upashastri Examination, 2017 as they have completed their course in the said institution.

Learned counsel for the petitioner referring to the notification dated 29.12.2 016 submits that the opposite party no. 2 has issued the forms for the students whereafter as required the affiliation fees has also been deposited on 24.01.2017. He points out the anomaly in the notification that when at one stage it is said that the affiliation fees has to be dep osited by 24.01.2017, it has been stated at another place that the filled up forms has to be s ubmitted by 20.01.2017 in respect of the District where the present institution situates. So, in view of that, the affiliation fee having been deposited within the time as finds mention in the notification, the forms are now not accepted as its date of submission as per the notific ation has expired when without deposit of affiliation fees, there stands bar for acceptance of forms.

Learned counsel for the opposite party no. 2 at this stage however without goi ng to counter the above submission fairly submits that in case the application forms being com plied with all the required formalities are submitted, the opposite party no. 2 would take the decision in the matter of allowing the students of the institution to appear in Upashastri Ex amination, 2017 keeping in view their interest and taking into account their sufferings in the event of being debarred from appearing in the Examination.

Considering the above submissions, this writ application is disposed of with a direction to opposite parties to do the needful in accepting forms of the students which had earlier been issued and affiliation fees from the petitioner-institution and accordingly take up the follow up process for their appearance in the Upashastri Examination, 2017 provided of course all other required formalities have already been complied with.
