03. 22.03.2017 Heard learned counsel for the petitioner as well as learned Go
vernment Advocate appearing for the State-opposite parties and perused the record.
2. The case of the petitioner is that he was granted lease of stone quarry for th
e plot in question for a period of three years with effect from 1.4.2014 and upto 31.3.2017.
3. Learned counsel for the petitioner submits that in view of the decision of the
Apex Court in the case of Deepak Kumar etc. v. State of Haryana & ors. etc. AIR 2012 SC 1386,
the minimum period of lease ought to have been granted, should have been five years and not t
hree years.
4. At this stage, learned counsel for the petitioner made a prayer that he may be
permitted to withdraw the writ petition with liberty to approach the authority concerned with
regard to the grievance made in this writ petition.
As such, we dispose of this writ petition with the liberty as aforesaid.
