Mr. B. Satpathy, learned counsel for the petitioner submits that similar question has
been considered by this Court and thereafter the apex Court has made it confirmed in Pabitra M
ohan Das etc. v. State of Orissa & Ors, JT 2001 (1) SC 473. In view of the law decided by the
apex Court, there is no need for further adjudication of the matter. Therefore, the writ petit
ion may be disposed of in the light of judgment passed in Pabitra Mohan Das etc (supra).
Mr.A.K. Mohanty, learned Standing Counsel for the School and Mass Education Departmen
t submits that he has no objection for such disposal.
Considering the contentions raised by the parties and on perusing the record, this Cou
rt disposes of the writ petition directing the petitioner to approach the authority by filing
a fresh representation to consider his case in the light of judgment passed in Pabitra Mohan D
as etc (supra). In the event, the petitioner files such a representation enclosing therewith a
copy of the judgment in Pabitra Mohan Das etc (supra) within a period of four weeks, the aut
hority shall consider the same within a period of three months thereafter.
Urgent certified copy of this order be granted on proper application.
