y the Deputy Labour Commissioner, Jeypore in P.W.C.C. No.1 of 1996.
It has been submitted by learned counsel Mrs. Das that their objection regardi
ng pendency of the claim by the opposite parties are before the Tribunal for adjudication bein
g O.A. No.463 of 1998 regarding payment of Night duty allowance for the period from 1.1.1993 o
nwards.
In view of that the Labour Commissioner should not have passed any order.
Since the O.A. is of the year 1998, the same might have been disposed of in th
e meantime. In case the same has been disposed of, it is open to the petitioner to produce the
said order before the Labour Court.
With this observation and direction, the writ petition stands disposed of.
