18.10.2017 This petition challenges the order dated 10.05.2016 passed by the learned Civi l Judge (Sr. Divn.), Puri in T.S. No.89/410 of 2006/1995, whereby and whereunder learned trial court rejected the application filed by the plaintiffs under Order 13 Rule 10 C.P.C. Heard Mr. A.P. Bose, learned counsel for the petitioners and Mr. Asok Mohanty,
learned Senior Advocate for the opposite party no.2.
When a query is being made by this Court as to what is the stage of the suit, learned counsel for the petitioners submits that evidence from both sides is closed.In view of the same, this Court is not inclined to entertain the petition.Accordingly, the petition is dismissed. Dr.A.K.Rath, J.
