Learned counsel for the petitioner submits that co-accused has already been released o
n bail by this Court and there is no any incriminating material seized from the possession of
the present petitioner. He further submits that investigation is at completion stage, for whic
h lenient view may be taken to release the petitioner on bail on any condition as deemed just
and proper. Learned Addl. Standing Counsel opposes the prayer for bail.
Considering the submissions of learned counsel for the respective parties, regard being
had to the facts and circumstances of the case including the fact that there is no recovery o
f any stolen material from the possession of the present petitioner, considering the nature of
the offence, fact that co-accused has already been released on bail by this Court, fact that
the petitioner being a local person, there is no chance of his absconding or influencing the
witnesses, let the petitioner be released on bail on furnishing bail bond of Rs.50,000.00 (rup
ees fifty thousand) with two solvent sureties each for the like amount to the satisfaction of
the learned SDJM, Chatrapur in G.R. Case No.263 of 2016 with the conditions that (i) The peti
tioner shall appear before the I.O. on every Sunday at 10 AM till submission of final form; (i
i) he shall not tamper with the prosecution witnesses directly or indirectly; and (iii) he sha
ll not commit any offence while on bail.
