Heard the learned counsel for the petitioner and learned counsel for t
he State.
This is an application under Section 439 Cr.P.C. in connection with G.R. Case
No.998 of 2017 arising out of Lalbag P.S. Case No.89 of 2017 pending in the Court of learned S
.D.J.M.(S), Cuttack for offences punishable under sections 323/324/506/436 of the Indian Penal
Code.
The petitioner moved an application for bail before the learned 3rd Additional
Sessions Judge, Cuttack which was rejected on 30.06.2017.
Learned counsel for the petitioner submits that the petitioner is in custody s
ince 04.06.2017 and in the meantime, investigation has made substantial progress and he has go
t no criminal antecedents. He further submits that the material available on record indicates
that after there was a quarrel between the petitioner and his wife, his wife left the petition
ers house and went to his fathers place and thereafter the petitioner set fire to his own hous
e.
Learned counsel for the State has produced the case diary and opposed the pray
er for bail.
Considering the submissions made by the learned counsels for the respective pa
rties, the nature of accusation against the petitioner, progress of
investigation and the period of detention of the petitioner in judicial custody, I am inclined
to release the petitioner on bail.
Let the petitioner be released on bail in the aforesaid case on furnishing bai
l bond of Rs.20,000.00 (rupees twenty thousand) with two solvent sureties each for the like am
ount to the satisfaction of the Court in seisin over the matter with further terms and conditi
ons as the learned Court may deem just and proper subject to condition that he shall appear be
fore the Investigating Officer as and when necessary.
Accordingly, the BLAPL is disposed of.
