It appears that investigation in this case has been completed and charge-sheet has alre
ady been filed. Similarly situated co-accused persons, namely, Manoj Gouda, Tapan Garada and J
ijikal Dangari have already been released on bail by this Court vide order passed in BLAPL No.
2849 of 2017. No specific overt act has been alleged against the petitioner. No material has a
lso been placed before this Court to show that the petitioner is a person of criminal antecede
nts and he shall abscond and/or tamper with the prosecution evidence, if released on bail.
Therefore, regard being had to the aforesaid facts and submissions made, especially the
nature of accusation, character of materials appearing against the petitioner in support of t
he charge, circumstances in which the offences alleged to have been committed, factum of relea
se of the similarly situated co-accused persons in the aforesaid bail application and completi
on of investigation and hardly any material being there to suggest that the petitioner is like
ly to abscond or tamper with the prosecution evidence, if enlarged on bail, I am of the view t
hat the petitioner in this case deserves to be released on bail.
Hence, the petitioner be released on bail in the aforesaid case by the Court in seisin
over the matter on such terms and conditions as it would deem just and proper.
Accordingly, the BLAPL stands disposed of being allowed.
Urgent certified copy of this order be granted on proper application.
