It is stated by the learned counsel for the petitioner that the application for renewa
l of licnece under Annexure-3 is pending before the opposite party no.3 Sub-Collector, Jagatsi
nghpur since 21.03.2016 and no decision has been taken thereon and the petitioner has not rece
ived any written communication from the opposite party no.3 in that respect and therefore, nec
essary direction may be issued to the opposite party no.3 to take a decision on Annexure-3 and
communicate the result thereof to the petitioner.
Learned counsel for the state has no objection in view of the limited nature of prayer
made by the learned counsel for the petitioner.
Considering the submissions made by the learned counsel for the respective parties, it
is directed that if no decision has been taken in relation to the application under Annexure-
3 as yet, the same shall be taken within a period of one month from the date of production of
the certified copy of this order by the petitioner which will be produced within period of one
week. The petitioner shall be given an opportunity of hearing in the matter. The result of th
e decision taken on the application shall be communicated to the petitioner within a period of
one week from the date of taking decision. If the decision has already been taken then the wr
itten communication shall be immediately made to the petitioner in writing.
It is made clear that this Court has not expressed any opinion on the merits of the ap
plication for renewal of the licence of the petitioner and the same shall be considered
strictly in accordance with law.
With this aforesaid observation, the writ petition is disposed of.
