This Writ Petition has been filed by the petitioner challenging the inaction of the Re
venue Authorities in not supplying the certified copies of Sabak and Hal records of Padia Patt
a Lease Case No.866 of 1971 to the petitioner.
Petitioner contended that her late husband was a landless person as such by virtue of
Padia Patta Lease Case No.866 of 1971, land was transferred in his favour. Accordingly, R.O.
R was prepared on 22.4.1981 in his name. He has paid rent and collected receipt thereof. The
petitioners husband died untimely. Thereafter, the petitioner has approached opposite party
No.2 to provide certified copies of sabak and current records vide C.A. No.248 of 2016 dated 2
9.2.2016. However, opposite party No.2 did not supply the same. Thereafter the petitioner fi
led an application under R.T.I Act and it was informed that the case records were not availabl
e in the office. It reveals that the petitioner has not furnished correct case number.
Considering the above, we disposes of this Writ Petition with an observation that in c
ase the petitioner files a fresh application before the Tahasildar, Nuagaon opposite party no
.2 for issuance of certified copies in respect of Padia Patta Lease Case No.866 of 1971 and th
e Record of Rights prepared thereof, in such event the said opposite party shall consider the
same in accordance with law.
