Considering the rival contentions of the parties and as this Court finds there is no s
cope for considering the case of the petitioner for being considered under Section 8(A) of the
OLR Act, 1960, the petition under Section 15 (B) of the OSS Act is very much maintainable. Lo
oking to the impugned order, this Court finds the matter was taken up on 9.2.2015 for consider
ation of the application for condonation of delay and while condoning the delay in making the
revision the Court on the same date decided the matter finally. Taking into consideration the
allegation of the petitioner that the case was posted for only considering the application for
condonation of delay and the parties were not ready to argue on the merit of the case and the
revision has been arbitrarily closed, this Court is inclined to interfere in the impugned ord
er and while setting aside the same, this Court remits the matter back to the Revisional Autho
rity for consideration of the matter afresh. The Revisional Authority is directed to dispose o
f the same after giving opportunity of hearing to both the parties concerned.
