2. The petitioner, being a Senior Clerk, under suspension, in the Office of the Odisha Lift
Irrigation Division, Sambalpur, has filed this writ petition challenging the order of suspens
ion dated 18.7.2016 passed by the Managing Director, Odisha Lift Irrigation Corporation Ltd.,
Bhubaneswar, opposite party no.2, as at Annexure-1. Learned counsel for the petitioner submit
s that the petitioner was never noticed before passing of the order of suspension.
3. However, it is the settled principles of law that before passing an order of suspension no
prior notice is required. In other words, the Departmental Authority or Appointing Authority w
hile initiating departmental proceeding against any of the employees may pass an order of susp
ension without following the principles of natural justice. Principles of natural justice wil
l come into play only in course of the departmental proceeding and no punishment can be inflic
ted upon the petitioner upon completion of Departmental Enquiry if the principles of natural j
ustice has been violated. So this Court finds no merit in the writ petition.
4. However, keeping in view the contentions made by the learned counsel for the petitioner, th
e petitioner is at liberty to file an appropriate representation along with the copy of
the brief and a certified copy of the order before opposite party no.2 for revocation of the
order of suspension within a period of seven days from today. On such an event, opposite part
y no.2 shall consider the representation after affording reasonable opportunity of hearing to
the petitioner and all
