Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner has filed this transfer application for transfer of G.R. Case No.1055 of
2013 from the Court of learned S.D.J.M., Panposh to the Court of the learned S.D.J.M., Keonjha
r.
It appears that on the First Information Report lodged by the opposite party No.2 Rasmit
a Behera before the Mahila Police Station, Sundargarh, Mahila P.S. Case No.41 of 2013 was reg
istered under sections 498-A/506 of the Indian Penal Code read with section 4 of the D.P. Act.
It is stated at the Bar that after completion of investigation, charge sheet has been submitt
ed against the petitioner.
Learned counsel for the petitioner submits that the petitioner is a resident of Keonjhar
and the opposite party No.2 is also staying in Keonjhar district and since this case arises o
ut of matrimonial dispute, for the general convenience of the parties, the case may be transfe
rred from the Court of learned S.D.J.M., Panposh to the Court of the learned S.D.J.M., Keonjha
r for trial.
