19.01.2016 This appeal is directed against order dated 03.09.2005 passed by the learned C
ivil Judge (Senior Division), Rourkela in C.M.A. No.39 of 2005 arising out of C.S.No.128 of 20
05.
2. Heard Mr.Ashok Ku. Parija, learned Senior Advocate appearing on behalf of the
appellant; none appears for the respondent.
3. The dispute relates to lying of pipe line to the appellant-industry on the emb
ankment of land of the respondent. While issuing notice in the matter, by order dated 14.12.20
05, this Court had directed the respondent not to tamper with the pipe line already laid by th
e appellant in the suit schedule property till the next date and the said interim order is con
tinuing till today. In the meantime ten years have already lapsed.
The suit being of the year 2005, this Court feels that interest of justice wou
ld be best served if a direction is made for early disposal of the suit.
4. In that view of the matter, this Court directs the learned Civil Judge (Senior
Division), Rourkela to dispose of C.S. No.128 of 2005 as expeditiously as possible, preferabl
y by end of August, 2016, if the same is still pending, of course affording opportunity of hea
ring to both parties. Interim order dated 14.12.2005 shall remain in force till disposal of th
e suit.
5. With the aforesaid observation and direction, the appeal stands disposed of.
