This application has been filed challenging the order dated 07.4.2014, passed by the l
earned Civil Judge (Sr.Divn.), Jajpur, in C.S. No.51 of 2012, rejecting the application of the
plaintiff-petitioner filed under Order 6 Rule 17 CPC for amendment of the plaint.
During course of hearing learned counsel for the petitioner prays for withdrawal of th
e application, with liberty to file appropriate application before the learned trial Court for
withdrawal of the suit, with liberty to file a fresh suit with better particulars.
Granting such liberty, CMP is disposed of as withdrawn.
Interim order dated 09.5.2014 stands vacated.
