Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is in custody as an accused in G.R Case No. 297 of 2015 on the
file of learned J.M.F.C., Khandapada registered under Sections 452/326/34, I.P.C..
It has been alleged that the accused caused injuries to the victim by throwing acid on
her head and face. Learned counsel for the informant submits that the victims face has be
en permanently disfigured and her life has been spoiled.
It is submitted by the learned counsel for the petitioner that the victim has got some
minor injuries on her face and she has married in the meantime. It was also submitted that th
ere was civil dispute between the parties and the victim as well as her mother were arrested o
n the F.I.R. lodged by the mother of the petitioner for being assaulted by them.
Learned counsel for the State was directed to obtain the latest photograph of the vict
im along with the instruction regarding her marriage.
As per the report obtained, the victim has got married but she refused to give her lat
est photograph to the Investigating Officer. The petitioner is in custody since 22.11.2013.
Considering the submissions and the materials placed before the Court, it is d
irected that the petitioner be released on bail on executing bond of Rs.20,000/-
( rupees twenty thousand) with one surety for the like amount to the satisfaction of the lear
ned J.M.F.C., Khandapada with the conditions that he shall not tamper with the prosecution ev
idence in any manner whatsoever, shall not give out any threat towards the victim and her moth
er and shall not default in personal attendance in court during trial at least on two consec
utive dates.
The BLAPL is accordingly disposed of.
