03. 03.08.2016 Petitioner having been in custody in S.T. Case
No.54 of 2016 arising out of G.R. Case No.879 of 2015 corresponding to Jankia P.S. Case No.10
4 of 2015 pending in the Court of the 1st Additional Sessions Judge, Khurda registered for all
eged commission of offence punishable under sections 498-A/304-B/302/34, I.P.C. read with sect
ion 4 of the D.P. Act has filed this application for his release on bail. On earlier occasion,
the prayer for bail of the petitioner having been rejected in BLAPL NO.7320 of 2015, he has n
ow again applied for bail.
Heard learned counsel for the petitioner and the learned counsel for the Stat
e.
Regard being had to the submissions especially the role assigned by the witnes
ses to this petitioner, who is the husband of the deceased, in the alleged incident, and the c
ircumstances in which the offences alleged are said to have been committed, viewing the stage
of the trial, while being not inclined to grant bail to this petitioner, it is observed that t
he trial court would do well to conclude the trial as expeditiously as possible preferably wit
hin a period of six months from the date of communication of this order.
Learned Additional Standing Counsel is directed to impart necessary instructio
n to all concern for the said purpose in the light of the above direction.
The BLAPL is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
