 Heard learned counsel for the petitioner and learned counsel for the State.

 This is an application under Section 439 Cr.P.C. for grant of bail to the petitioner i
n connection with G.R. Case No. 33 of 2016 corresponding to Gudari P.S. Case No. 8 of 2016 pen
ding in the Court of learned S.D.J.M., Gunupur for offences punishable under sections 363/366/
34 of Indian Penal Code.

 The petitioner moved an application for bail before the learned Addl.Sessions Judge, G
unupur which was rejected on 14.3.2016.

 Learned counsel for the petitioner submits that the petitioner is in custody since 27.
2.2016 and in the meantime, the investigation has made substantial progress and the statement
of the victim indicates that there was no physical relationship between the petitioner and the
 victim and in support of such contention, he placed the 161 Cr.P.C. statement of the victim.
 Learned counsel for the State has produced the case diary and opposed the prayer for b
ail.

 Considering the submissions made by the learned counsels for the respective parties, n
ature of accusation against the petitioner and the period of detention of the petitioner in ju
dicial custody as well as the substantial progress of the investigation, I am of the opinion t
hat it is a fit case for grant of bail to the petitioner.

aforesaid case on furnishing a bail bond of Rs. 20,000/- (Rupees twenty thousand) with two so
lvent sureties each for the like amount to the satisfaction of the learned Court in seisin ov
er the matter with further terms and conditions as the learned Court may deem just and proper.

The BLAPL is accordingly disposed of.
